本条款构成您与服务提供方（以下简称 “我方”）之间关于使用本服务的完整协议，明确双方在服务使用过程中的权利与义务。
您访问及使用本服务，即视为您已接受并同意遵守本条款的全部内容。如您不同意任何条款，请勿使用本服务。
您声明并保证已年满 18 周岁，我方不向未成年人提供服务。
同时，您的使用行为亦受我方隐私政策约束。请在使用前仔细阅读隐私政策，了解个人信息的收集、使用及保护规则。

本服务可能包含指向非我方运营的第三方网站或服务的链接。
我方对第三方平台的内容、隐私政策及运营行为不具有控制权，亦不承担任何责任。您因使用第三方服务导致的任何损失，我方不承担连带义务。
建议您在访问第三方平台前，详细查阅其服务条款及隐私政策。

如您违反本条款或其他适用规则，我方有权立即终止或暂停您的服务访问权限，且无需提前通知。
服务终止后，您使用本服务的权利将即时失效。

无论何种情形，我方及相关合作方的全部责任上限，均限于您通过本服务实际支付的费用；如无付费行为，则以 100 美元为限。
在法律允许的最大范围内，我方及相关合作方不对任何间接、偶然、特殊或后果性损失（包括但不限于利润损失、数据丢失、业务中断、人身损害等）承担责任，即便已事先被告知此类损失的可能性。
部分司法辖区对责任限制有特殊规定的，从其规定。

本服务按 “现状” 及 “可获得性” 提供，不附带任何明示或默示保证。我方及相关方明确放弃对服务的适用性、无瑕疵性、持续性等作出承诺，具体包括但不限于：
不保证服务符合您的特定需求或预期结果；
不保证服务与其他软件、系统的兼容性；
不保证服务无中断、无错误或缺陷可被修复；
不保证服务内容的准确性、安全性（包括但不限于无病毒或有害组件）。
司法辖区另有强制性规定的，从其规定。

本条款受美国纽约州法律管辖（排除冲突法规则）。
如发生争议，您同意优先通过与我方协商解决。

欧盟地区用户可依据居住地的强制性法律规定主张权利。

您承诺：
不在受美国政府禁运或认定为 “支持恐怖主义” 的国家或地区使用本服务；
未被列入美国政府的禁止或限制交易名单。

若本条款任何内容被认定为无效或不可执行，不影响其他条款的效力。
我方未行使或延迟行使本条款项下的权利，不视为对该权利的放弃。

如本条款存在多语言版本，发生争议时以英文原文为准。
我方保留随时修订本条款的权利。如修订内容涉及重大变更，将至少提前 30 天通知。您继续使用服务的，视为接受修订后的条款。

User Agreement

These terms constitute a complete agreement between you and the service provider (hereinafter referred to as "we/us") regarding the use of this service, clarifying the rights and obligations of both parties in the process of using the service.
Your access to and use of this service shall be deemed as your acceptance and agreement to abide by all the contents of these terms. If you do not agree to any of the terms, please do not use this service.
You represent and warrant that you are at least 18 years of age, and we do not provide services to minors.
Meanwhile, your use of the service is also subject to our privacy policy. Please read the privacy policy carefully before use to understand the rules for the collection, use and protection of personal information.

This service may contain links to third-party websites or services that are not operated by us.
We have no control over the content, privacy policies or operational behaviors of third-party platforms and shall not assume any responsibility. We shall not assume any joint liability for any losses caused by your use of third-party services.
It is recommended that you carefully review the service terms and privacy policies of third-party platforms before accessing them.

If you violate these terms or other applicable rules, we reserve the right to immediately terminate or suspend your service access rights without prior notice.
Upon termination of the service, your right to use this service will be immediately invalidated.

In any case, the total liability of us and related partners shall be limited to the actual fees you have paid through this service; if there is no payment behavior, it shall be limited to 100 US dollars.
To the maximum extent permitted by law, we and related partners shall not be liable for any indirect, incidental, special or consequential damages (including but not limited to loss of profits, data loss, business interruption, personal injury, etc.), even if we have been informed in advance of the possibility of such damages.
Where there are special provisions on liability limitation in some jurisdictions, such provisions shall prevail.

This service is provided "as is" and "as available" without any express or implied warranties. We and related parties expressly disclaim any commitment to the applicability, defect-free nature, continuity, etc. of the service, including but not limited to:
We do not guarantee that the service meets your specific needs or expected results;
We do not guarantee the compatibility of the service with other software and systems;
We do not guarantee that the service will be uninterrupted, error-free or that defects can be repaired;
We do not guarantee the accuracy and security of the service content (including but not limited to the absence of viruses or harmful components).
Where there are mandatory provisions in the jurisdiction, such provisions shall prevail.

These terms shall be governed by the laws of the State of New York, USA (excluding conflict of law rules).
In case of any dispute, you agree to first try to resolve it through negotiation with us.

Users in the EU region may claim rights in accordance with the mandatory legal provisions of their place of residence.

You undertake that:
You will not use this service in countries or regions that are embargoed by the U.S. government or identified as "supporting terrorism";
You are not included in the list of prohibited or restricted transactions by the U.S. government.

If any part of these terms is deemed invalid or unenforceable, it shall not affect the validity of other terms.
Our failure to exercise or delay in exercising any right under these terms shall not be deemed a waiver of such right.

If there are multiple language versions of these terms, the English original shall prevail in case of any dispute.
We reserve the right to revise these terms at any time. If the revised content involves major changes, we will notify you at least 30 days in advance. Your continued use of the service shall be deemed as acceptance of the revised terms.
